    REQUEST FOR PROPOSAL

     

     

    The Town of Coventry is soliciting sealed Requests for Proposal; hereinafter referred to as RFP, for the following:

     

    POLICE UNIFORMS

     

     

    Bids will be received until 3:00 p.m. on Friday, July 6, 2018, by the Town Clerk’s Office located at 1670 Flat River Road, Coventry, RI 02816.  Normal business hours for the Town of Coventry are Monday through Friday between the hours of 8:30 a.m. to 4:30 p.m.  Town offices are closed on recognized holidays. 

     

    Sealed bids will later be opened and read publicly.  Any bid received after the closing time will not be accepted and will be returned to the bidder unopened.  It is the responsibility of the bidder to see that any bid submitted shall have sufficient time to be received by the Town Clerk’s Office prior to the bid opening date and time.  The receiving time in the Town Clerk’s Office will be the governing time for acceptability of the bids.  Bids will not be accepted by telephone, email or facsimile machine.  All bids must bear original signatures and figures.

    INSTRUCTIONS TO VENDORS

     

    1. BIDS/PROPOSALS:

    Instruction forms and specifications may be obtained in person, online or by mail at the Office of the Town Clerk, 1670 Flat River Road, Coventry, RI 02816, beginning Wednesday, June 20, 2018.  Bids shall be submitted on the RFP form and clearly marked “Police Uniforms” on the exterior of the envelope packet.  Sealed bids or proposals will only be accepted by the Town of Coventry if submitted in accordance with these instructions, the General Conditions and any other attached specifications.

    2. QUALIFICATIONS:

    The Town may make such investigation as it deems necessary to determine the ability of the bidder to furnish the services, and the bidder shall furnish to the Town all such information and data for this purpose that the Town may request.  The Town re­serves the right to reject any bid if the evidence submitted by the bidder or an investigation of such bidder fails to satisfy the Town that such bidder is properly qualified to carry out the obligations of the contract.

    3. REQUIRED ATTACHMENTS TO BIDS:

    Each bid shall be accompanied by the following which are attached herewith:

    a. Notarized Affidavit (non-collusion oath) executed by the Bidder, or if the bidder is a corporation, executed by a duly authorized representative of the corporation;

    b. Vendor Responsibility form; and

    c. Equal Opportunity Employer form.

    4. ACCEPTANCE OR REJECTION OF BID RESERVATIONS:

    The Town will accept or reject bids within ninety (90) days of the date after the bids are opened.  The Town reserves the right to reject or accept any or all bids or portion thereof  where such acceptance or rejection would, in the Town's sole discretion, be in the best interest of the Town, and further reserves the right to reduce or modify the scope of the project in order to meet funding limits, budget and scheduling constraints.

    5. ADDENDA:

    Any addenda, including response(s) to bidders’ questions, issued after the request for bids are distributed shall be covered in the bid, and in closing the contract, they shall become a part thereof.

    6.  SPECIFICATIONS:

    Bidders must examine the specifications carefully. In case doubt shall arise as to the meaning or intent of anything shown in the specifications, inquiry shall be made in writing to the Town before the bid is submitted. The submission of a bid shall indicate that the bidder thoroughly understands the terms of the RFP and specifications.

    GENERAL CONDITIONS

    1. RESERVATIONS:

                    a. The Town reserves the right to waive formalities or technicalities in bids as the interests of the Town may require.

                    b. The Town may waive minor differences in specifications provided these differences do not violate the intent of the specification or materially affect the operation for which the item is being acquired.

                    c. Bids which show omission, irregularity, alteration of forms, or additions not called for, and conditional or unconditional, unresponsive bids or bids obviously unbalanced may be rejected.

                    d. The Town reserves the right to award contracts on a lump sum or an individual item basis or such combination thereof as the interests of the Town may require. 

                    e. If in the Town’s judgment, the Town’s best interest will be served by doing so, the Town  reserves the right to reject any and/or all bids; to accept a portion of a bid or bids only; to advertise for  new bids; to proceed to do the work otherwise; or to abandon the work.

    2. DISPUTES:

    In cases of disputes as to whether or not an item or service quoted or delivered meets the specifications, the decision of the Town shall be final and binding on both parties.

    3. FAILURE TO DELIVER:

    In the event the Contractor fails to deliver the services and materials covered by the contract and in accordance with the delivery terms stipulated in the contract, then the Town will have the right to purchase on the open market the services and/or materials covered in the Bid Proposal and shall have as damages the cost of obtaining such services and/or materials and any additional costs incurred by the Town as a result thereof.

    4. INSURANCE:

    The Contractor shall maintain such commercial general li­ability and broad form property damage insurance and Workers’ Compensation Insurance as will protect the Town from any and all claims under Workers’ Compensation Acts, and from any other claims for loss or damages or for general injury or damage to property which may arise from Contractor’s operations under the contract; whether such operations be by themselves or by any subcontractor or anyone directly or indirectly employed by either of them. Certificate of Insurance shall be on an occurrences basis.

    The Contractor shall name the Town as additional insured to the required insurance policy and will furnish a Certificate of Insurance or other acceptable evidence of insur­ance coverage to the Town within ten (10) days from date of award, but in no event later than the date of execution of the Contract.

                    a. Comprehensive Liability Insurance:   Limits of Coverage (Applies ONLY to Contractors performing services in and/or for the Town; NOT for supply only Contracts) for commercial general liability and broad form property damage coverage are to be no less than Five Million Dollars ($5,000,000.00) occurrence/Five Million Dol­lars ($5,000,000.00) aggregate personal injury and death and Five Million Dollars ($5,000,000.00) property damage. Five Million Dollars ($5,000,000.00) aggregate, where insurance aggregates apply.

                    b. Automobile Liability Insurance:  Motor vehicle insurance meeting the requirements of Rhode Island law and covering every vehicle and driver involved in providing the services, in the following amounts:    

    (1) Bodily injury liability with limits of $500,000.00 each person and $5,000,000.00 each accident; 

    (2)  Property damage liability with a limit of $100,000 each accident.

     

                   c. Workers’ Compensation:  Contractor shall maintain Worker’s Compensation coverage for the duration of the contract. Evidence of coverage must be presented before the final contract is signed by the Town.

    Failure to provide current insurances shall result in a closure of the concession facilities and termination of the contract.

    5. INDEMNIFICATION:

    The successful bidder will be required to indemnify, defend and hold the Town harmless against any and all liability to any person or persons or damage to any property for or by any reason of any condition or malfunction of the materials used, and against any and all claims made or liability to any person or persons by reason of any act or omission or negligence of the bidder or any of its agents, servants, or employees.  This indemnification shall include reasonable attorney’s fees incurred by the Town in connection with such claim or liability.  

     

    Vendor further agrees to indemnify and hold harmless the Town from and against any and all liability in any way arising out of or related to Vendor’s operation of these concessions and/or performance of its obligations hereunder.  The indemnity shall be the broadest form available and shall include indemnity against any liability arising out of or caused by the negligence of the Vendor, its agents, subcontractors, and employees.

     

     

    6. INSPECTIONS:

    The Town has the right to inspect and test all services and materials called for by the contract, to the extent prac­ticable at all times and places during the term of the contract. The Town shall perform inspections and tests in a manner that will not unduly delay the work.  If any of the services and/or materials do not conform to contract specifications, the Town may require the contractor to perform the service or again provide a replacement product in con­formity with contract specifications, at no increase in contract amount.

    BID SPECIFICATIONS

     

    1. Duty Uniform Shirts and Trouser:
      1. There are 57 police officers within the department.  Each will be furnished with two winter uniform shirts, and two summer uniforms shirts, two pairs of pants, and two external vest carriers. These quantities are estimated, no minimum quantities are guaranteed.  All pants, shirts, and carriers are black.
        1. Alterations:
          1. All alterations will be done at no additional charge except for those listed in the bid proposal form.
          2. Shirts - Alterations of uniform shirts shall include a patch sewn on the left shoulder and a number board sewn above the right breast pocket, a pair of epaulets sewn on the shoulders 4 metal buttons on all shirts. Department patches will be provided by the Police Department.  This work shall be at no extra charge to the Town. 
            1. Alterations will include whatever it takes to properly fit the member of the department to include torso and sleeves.
            2. Sergeants’ shirts will also have gray chevrons sewn on each arm at mid-sleeve.
          3. Trousers - Trousers will have a knife (aka billy club) pocket if the officer requests same on one side (officer’s choice). 
            1. Alterations will include those made to the waist, length and crotch to ensure a proper fit to each officer. 
        2. Work wear industrial style Shirts and Trousers are unacceptable and shall be cause for rejection.

     

      1. Winter Uniform Shirts
        1. Blauer, or pre-approved equal.  Blauer shirts are identified as model 8371 (L/S) and model 8372 (S/S).
          1. Long Sleeve.
          2. Color – Black
          3. Uniform shirts shall include a patch sewn on the left shoulder and a number board sewn above the right breast pocket, a pair of epaulets sewn on the shoulders 4 metal buttons on all shirts.                    
            1. Epaulets - To measure 2” at sleeve tapering to 1-3/8” and set not more than ½” from collar set seam.  Cross stitched 2” from sleeve seam. Shoulder straps to have functional buttonhole to attach to sewn button on shoulder of shirt.  Edge stitched shoulder strap construction unacceptable. Custom with double stiffened heat proof plastic inercore royal blue edge, black center with a black pellon finished bottom.
            2. Buttons - Four metal buttons per shirt, two on epaulets two on pocket flaps.  
          4. Dress style, top center placket front, full cut tapered fit, banded collar, long sleeves with barrel cuffs, and dress shirttail.  Two pleated breast pockets with topstitched scalloped flaps.  Topstitched shoulder straps.  Full badge reinforcement.  Matching inside yoke and collar band of Dacron/Cotton Poplin.
          5. Work wear industrial style shirt construction is unacceptable and shall be cause for rejection.
          6. Badge Reinforcement - Two-ply sling 1” wide centered over left pocket and stitched to shoulder seam and flap setting stitch.  It shall have 2 (two) buttonhole eyelets 1 ¼ “from top of pocket flap spaced 1 ¼” apart and centered on sling.
          7. Pockets - Two breast patch pockets with mitered corners and 1 ½ stitched pleats.  Pleats shall be stitched top and bottom and full length of pleat to prevent spreading.  Pocket to measure 5 5/8 wide 6” deep.  Left breast pocket to have 1- ½” pencil stitch.  Each pocket to have hook Velcro or approved equal ¾” long by ½ wide.
          8. Flaps - Two piece deep scalloped design to measure 5- 7/8   across and 2- ¾  in depth at center point, 2 ¼ at sides.  Secured to shirtfront approx.3/8” above pocket.  Left flap to have invisible pencil opening 1 ½ to correspond precisely with pencil slot of pocket. Stop and start stitching for pencil opening unacceptable and shall be cause for rejection..  Flaps to be ¼” topstitched.  Flaps to have woven interlining of #550 stabilized Mello-Press or approved equal. Creased and edge stitched pocket flap construction unacceptable.  Under side of the flap to have  looped Velcro or approved equal ¾ long by ½ wide stitched all sides, positioned on outer points of both pocket flaps to secure with corresponding Velcro strips on shirt pocket.
          9. Each flap shall have a button centered on uncut sewn buttonhole.
          10. Sleeves - Sleeve vent shall be a minimum of 4 ½ long with one-piece top and bottom facings.  Facing to measure 1 1/8 wide point blocked at top.
          11. Cuffs - Two piece ½ inch hemmed cuff with ¼’ topstitching.  Cuffs to measure 3” in depth with rounded corners barrel cuffs.  Cuffs to have two buttons and corresponding buttonholes set vertically with one button and buttonhole in center of facing.  Cuffs to have woven interlining of #550 Stabilized Mello-Press or approved equal.
          12. Military Creases - There shall be five sharp silicone military creases on all shirts.  One crease on each front to be centered vertically. Front creases shall be through pockets and flaps. Spacing for three military creases across shirt back to be proportionate to the size of the shirt.
          13. Convertibility - This garment shall be designed to accommodate removable metal buttons having eyelets under the sewn buttons on the button front, cuffs and shoulders.  Each pocket will have one vertical eyelet to accommodate removable metal buttons.  There are protective pieces on the inside of the garment on the shoulders and cuffs, as well as a reinforcing strip inside the right front.
          14. Construction - Collars, flaps and cuffs are made with conventional construction.  Top ply, bottom ply and interlining are first stitched together, then turned right side out and topstitched.
          15. Patches - The official police department patch supplied by the department and sewn on by the vendor. Number boards, sergeant stripes, service bars all to match sewn on and supplied by the vendor.
          16. Stock Sizes - Shirts must be available in the following sizes:
          17. Sleeve lengths - 32-37 inches
          18. Neck sizes - 14 ½ to 18 ½, 19, 20, 21, and 22.
      2. Summer Uniform Shirts and External Vest Carrier

    ***for purposes of this specification, the term “shirt” or “carrier” may                    be used interchangeably.  The department is looking for two of each***

        1. Blauer, or approved equal.
          1. Short Sleeve Shirt/Carrier is Sleeveless.
          2. Color – Black
          3. Shirt shall include a patch sewn on the left shoulder and a number board embroidered above the right breast pocket, a pair of epaulets sewn on the shoulders 4 metal buttons on all carriers.
            1. Epaulets - To measure 2” at sleeve tapering to 1-3/8” and set not more than ½” from collar set seam.  Cross stitched 2” from sleeve seam. Shoulder straps to have functional buttonhole to attach to sewn button on shoulder of carrier.  Edge stitched shoulder strap construction unacceptable. Custom with double stiffened heat proof plastic innercore charcoal gray edge, black center with a black pellon finished bottom.
            2. Buttons - Four metal buttons per shirt, two on epaulets two on pocket flaps.
          4. Work wear industrial style shirt construction is unacceptable and shall be cause for rejection.

Labels - Trousers must have a permanent label providing care instructions and small woven label indicating waist size.  A removable paper ticket showing the size, fabric content, cut number and WPL or RN number must be on the outside of the waistband.  Ticket to be matchbook style installed with plastic staples for easy removal without damaging trouser material and showing size when trousers are stacked.

    APPENDIX A

    TOWN OF COVENTRY, RHODE ISLAND

    CHARTER

     

     

    (SECTION 7.07. DIVISION OF CONTRACT AND PURCHASE)

     

    1. The division of contract and purchase shall consist of the purchasing agent who shall be the head of the division, and such other employees as may be provided by ordinance, from time to time. The purchasing agent shall be a person skilled in the areas of governmental or private business purchasing and property control and accountability and he/she shall have such other skills as the Town council may from time to time require by ordinance.  He/she shall be appointed for an indefinite term by the Director of Finance as provided in Sec. 7.02.

     

    1. The Board of Contract and Purchase shall consist of the following members:

                     

    1. The Director of Public Works.
    2. The Director of Finance.

    3)         The president of the council or his designee shall appoint one (1) private citizen, who shall be a person skilled in governmental or private business purchasing and property control and accountability, appointed in the month of January of each year.

    4)         Two (2) private citizens, who shall be persons skilled in governmental or private business purchasing and property control and accountability, appointed in the month of January of each year by the leader of the majority party in the council.

    5)         Two (2) private citizens, who shall be persons skilled in governmental or private business purchasing and property control and accountability, appointed in the month of January of each year by the council minority leader or if there be no such a minority member of the council then the appointment shall be made by the Town chairman of the political party whose endorsed candidate for a Town wide council seat received the most votes next after the lowest number of votes cast by the electorate for a successful candidate for a Town wide council seat in the preceding election or his designee.

     

    Any vacancy on the Board of Contract and Purchase shall be filled in the same manner as the original appointment for the remainder of the unexpired term.

     

    1. The Board of Contract and Purchase shall meet at least twice a month and such meetings shall be held no earlier than 5:00 p.m. Eastern Standard Time and its agenda shall be advertised in a paper of local circulation at least one (1) week prior to the meeting.  The exact time, date, place and conduct of said meetings shall be specified by ordinance.  All meetings of the Board of Contract and Purchase shall conform in all respects to the State of Rhode Island Open Meetings Law.

     

    1. All contracts awarded by the Board of Contract and Purchase must contain a starting date and a termination or completion date. Any contract which does not have a starting date or termination or completion date shall be void.  No contract awarded by the Board of Contract and Purchase shall be extended past its termination date or completion date unless an extension is granted by the Board of Contract and Purchase at a regularly scheduled meeting of the Board. Any contract extended past its termination or completion date without a proper vote of the Board shall be void.

     

    1. No contract awarded by the Board of Contract and Purchase shall be extended or amended if the result of said extension or amendment is to materially alter the terms of the original contract.  A material alteration for the purposes of this section is an alteration or extension of a contract which increases the original contract amount by more than fifteen (15%) percent.  Any contract which the Board wishes to materially alter must be rebid pursuant to the terms and conditions set forth in Section 7.09 of this Charter for awarding contracts.  Any contract which is materially altered and which has not been rebid is void. 

     

    1. All bid packages or Request for Proposals issued by the Purchasing Agent, the Board of Contract and Purchase, the various Departments or Divisions of Town Government or any Board or Commission created by Charter or Ordinance shall include in their bid packages or Request for Proposals a copy of this section, Section 7.07 entitled, “Division of Contract and Purchase”. All bidders who receive a bid package or a Request for Proposal and bid shall be presumed to know that any contract which violates any provision of this section is void.

     

    1. Any contract which violates the provisions of this section shall be deemed void and the Town Solicitor at the direction of the Mayor or Town Council, by a majority vote of the council, shall commence suit to recover all moneys expended by the Town pursuant to the terms of said void contract.  (Reso. No. 94-38,6-27-94, approved at referendum 11-8-94).
