ZONING ORDINANCE AMENDMENT
ARTICLE 10 – EARTH REMOVAL/SAND AND GRAVEL EXTRACTION
Notice is given pursuant to Rhode Island General Laws 45-24-53 that a Public Hearing will be held in the Council Chambers, Town Hall, 1670 Flat River Road, Coventry, Rhode Island on Monday, March 8, 2021 at 6:00 P.M.
The Town Council seeks an amendment to Article 10 of the Coventry Zoning Ordinance, which previously established the Zoning Board of Review as the reviewing authority for the granting of a Special Use Permit for earth removal operations. The proposed amendments include changes to ensure the protection of abutters of earth removal operations and also help clarify the application process for obtaining a Special Use Permit for the activity. The proposed amendments include that all Town Ordinances in effect at the time of renewal of a Special Use Permit shall apply to the renewal. The notification area for a Special Use Permit for earth removal shall be set at 1200’ from the property boundaries of the earth removal operation. All Special Use Permits grated for earth removal shall be subject to review by the Zoning Board within six (6) months of the start of earth removal activity and all Special Use Permits shall be effective for a maximum of two (2) years. The buffer area for earth removal operations from any occupied dwelling has been increased from 600 to 1000 feet. The proposed amendments include the authority of the Zoning Board to: place limitations on the height of stockpiled materials; require that materials and access roads be watered as needed to reduce or eliminate dust; and, to require the construction of buffers and/or fencing from the earth removal operations. Lastly, the proposed amendments provide for the protection of excavation that is part of an existing and established agricultural operation or is otherwise protected under R.I. Gen. Laws § 2-23-1, et seq., also known as the “Right to Farm” Act.
If approved, the Zoning Ordinance Amendment will take effect upon passage.
This proposed Zoning Ordinance Amendment may be altered or amended prior to the close of the public hearing without further advertising, as a result of further study or because of the views expressed at the public hearing. Any alteration or amendment concerning this Zoning Ordinance Amendment must be presented for comment in the course of the hearing.
